Your challenge

  • International conventions strictly limit the liability of both shippers and carriers for damage to or loss of goods.
  • Compensation is based on weight or the number of packages; it takes no account whatsoever of the value of the goods, and will therefore, in most cases, fall well short of your expectations.
  • Compensation will only be paid if you can provide irrefutable proof of fault on the part of the shipper or the carrier — proof that is very difficult to obtain.
  • International conventions provide no compensation in the event of natural disasters, which are unfortunately becoming more and more frequent.

Our solution

  • An insurance policy guaranteed at preferential rates through the KPM Logistics / ALLIA INSURANCE BROKERS partnership.
  • An insurance policy that can cover not only the value of the goods, but also air or sea transport costs, as well as the commission where the purchase was made through our Central Purchasing service.
  • An insurance policy with "All Risks" cover as provided for in Article 8 of the terms of the Antwerp Policy of 20 April 2004, with no deductible.

How to proceed

Simply request insurance cover when your transport document is being drawn up.

Disclaimer

  • The maximum cover provided by the policy is €250,000.00 per shipment.
  • Cover is granted against payment of the premium as shown on your waybill, taxes and administrative fees included.
  • The insurance company may refuse your request for cover at its sole discretion; failing cover, the shipment remains governed by the International Conventions in the event of a claim.
  • Proof of a request for cover is your responsibility, and is only valid once you have personally received the confirmation email.
  • Claims are recovered by ALLIA INSURANCE BROKERS, our broker, who is owed a 1% commission on the amount recovered.

Goods subject to special terms with an additional premium

  • Precious metals, worked or unworked, coined or uncoined, jewellery, fine or cultured pearls, precious stones, jewels, furs.
  • Vehicles (make, model, year of manufacture and value required).
  • Securities, coupons, cash, cheques, promissory notes or bearer bonds, documents of any kind.
  • Live plants and cut flowers.
  • Fresh fruit and vegetables.

Excluded goods

  • Any goods prohibited by law.
  • Any goods whose handling poses a risk of bodily injury and/or property damage.

Standard procedure

  • A proper invoice must be provided.
  • Goods must be transported in their original packaging or, failing that, must have been repacked by a professional packer duly accredited by KPM Logistics.
  • KPM Logistics reserves the right to verify that the goods are in perfect condition and match the description on the invoice.

Information needed to calculate the premium

For any insurance policy to be taken out, the following information must be provided:

  • Waybill number
  • Destination
  • Shipper's full name
  • Recipient's full name
  • Packing details (weight and number of packages/pallets)
  • Departure date
  • Amount to be insured (transport cost + value of the goods)
  • Nature of the goods
  • Name(s) of the supplier(s)
  • Invoice number(s)

Calculating the premium

  • The premium is calculated based on the rates shown in the tables below, which apply to the declared value of the transport and/or the goods.
  • The premium is increased by a tax of 1.4%.
  • A minimum premium of €40.00 per shipment applies.
  • For each file, administrative fees set at 10% of the insurance premium amount apply, with a minimum of 35 EUR/USD.
  • For the KPM Logistics China agency, additional administrative fees of €45.00 per file apply.

Special cases

Jewellery

  • A proper invoice must be provided.
  • KPM Logistics reserves the right to verify that the goods are in perfect condition and match the description on the invoice.
  • For this type of sensitive goods:
    • If the value is less than €25,000.00, the premium rate applicable will be that of standard fragile-type goods.
    • If the value is more than €25,000.00, an express request must be made to our broker, who will have full discretion to decline the risk; in that case, the shipment will once again be governed, in the event of a claim, by the International Conventions.

Works of art

  • This insurance covers any work of art purchased directly from the artist by KPM Logistics' contracting client.
  • The value to be insured is the purchase value, plus packing and transport costs.
  • In the event of loss, the insured value must be substantiated by producing the purchase, packing and transport invoices.
  • In the event of damage to the insured item, an expert assessment will establish the actual value of the damage.
  • The premium rate is 1.85%.

* The following are considered "fragile goods":

  • Any goods made of glass in the broadest sense, or containing glass, such as a car windscreen, crockery, a mirror, a glass-fronted cabinet, etc.
  • Devices fitted with a screen, such as a television, a computer, an ultrasound machine, etc.

The premium rates shown above apply to all KPM Logistics agencies.

Special cases:

  • For air freight shipments passing through a HUB (a goods sorting and routing centre), the premium rate is increased by 0.05% for "non-fragile" goods and 0.10% for "fragile" goods.
  • For multimodal shipments (use of several modes of transport for the same shipment), the premium rate is the sum of the rates applied for each mode of transport.
  • For shipments destined for a remote area, provided it has an airport with a paved runway, the premium rate is increased by 0.075% for "non-fragile" goods and 0.125% for "fragile" goods.
  • For shipments from Johannesburg → Lubumbashi (by road) → Kinshasa (by air), the premium rate is increased by 0.45% for "non-fragile" goods and 1.00% for "fragile" goods.

In the event of a claim

A file will be prepared and submitted to the insurance company. This file must include the following documents:

  • Incident report (standard KPM Logistics agency document)
  • Copy of the waybill
  • Copy of the AWB (Air Freight) or the BL (Sea Freight)
  • Photos of the damage
  • Copy/copies of the invoice(s)

The client will be kept informed of the progress of the file until it is resolved.

Cover is to be supplemented by the following special conditions:

  1. Replacement clause
    • The insured undertakes, where a part of the insured item is lost or damaged, to have that part replaced or repaired if the insurers so request. The costs of returning to the factory, reshipping, replacement and repair are borne by the insurers. The loss of or damage to a part of the insured item cannot give rise to a right of abandonment, nor constitute the total loss of that insured item, without prejudice to the right of abandonment for loss or deterioration amounting to 3/4 of the value.
  2. Exclusion clause
    • Rust, oxidation and discolouration are excluded if the goods are unpacked or insufficiently packed, unless they are the direct consequence of a covered risk.
    • Mere mechanical, electrical and/or electronic malfunction and/or faults are excluded, unless they are the direct result of an accident or there are external signs of damage.
  3. Absolute Exclusions Clause: Sanction Clause CF101 of the Association Royale Belge des Assureurs Maritimes ASBL of 27 January 2011
    • Cover does not apply in any case where sanctions, restrictions or prohibitions are imposed by a national, international or supranational authority preventing insurers from providing insurance services.
    • In any event, cover excludes compensation for damage, loss and/or material costs caused directly and/or indirectly, wholly or partly, by or resulting from:
      • Risks of radioactive contamination and chemical, biological, biochemical or electromagnetic weapons, under the following clauses:
        • Exclusion of radioactive contamination and chemical, biological, biochemical and electromagnetic weapons, and exclusion of the abandonment of radioactive goods (Clause CF200 of the Association Royale Belge des Assureurs Maritimes ASBL of 27 May 2004) where the conditions of Articles 6, 7 or 8 of the Antwerp Insurance Policy on Goods of 20/04/2004 apply.
      • Risks of cyberattacks, under the following clause:
        • Exclusion of cyberattacks (Clause CF001 of the Association Royale Belge des Assureurs Maritimes ASBL of 27 November 2003) where the conditions of Articles 6, 7 or 8 of the Antwerp Insurance Policy on Goods of 20/04/2004 apply.
      • Any treatment to which the insured goods and property are subjected in order to undergo any internal or external modification (the "process clause").

NOTES:

  • Insurance cover begins upon signature of the shipping document and automatically ends upon signature of the goods receipt document.
  • In the event of a claim, KPM Logistics will draw up an incident report jointly with the recipient within 24 hours of the damage being noted. This report will be attached to the transport document and the insurance certificate. The resulting file will be forwarded by us to the insurance company. The damaged goods, first identified using the purchase invoice, will remain at the destination agency at the disposal of the insurance company, which will become their owner for a period of three months. Beyond this period, KPM Logistics reserves the right to stand in for the insurance company and may then dispose of the goods as it sees fit, in accordance with our Terms & Conditions (Article 4 — Carriage and delivery, § 4). This provision means that under no circumstances may the client keep or recover damaged goods for which a refund procedure has been initiated.
  • If KPM Logistics considers the shipment to be hazardous, in particular due to inadequate packaging, KPM Logistics may refuse to take out insurance. In that case, KPM Logistics cannot be held liable in any way, and the client will not be entitled to any compensation.
  • Although acting only as an intermediary, KPM Logistics undertakes to manage the claim file with the insurance company on behalf of its client; the administrative fees for this service are set at 5% of the amount of the damage refund (with a minimum of 35 EUR/USD). These fees will be deducted from the amount at the time it is paid. KPM Logistics may, however, at any time and at its sole discretion, decide to revert to its original role, namely, in the event of a claim, to forward the file to the relevant department of the company and put the client in touch with that department. In any event, the client may under no circumstances transfer the insurance company's liability onto KPM Logistics, for any reason whatsoever.
